Vicarious Liability

This is the liability an organization takes on for the actions of those who work on its behalf. This could be the liability of an organization that uses volunteers for the actions of a volunteer while that person is doing volunteer work for the organization. Refer to the volunteer information on how to select and train volunteers to help manage this risk.

Vicarious liability can also be that an employer can be automatically held liable for the wrongful actions of its employees. Acts of employees while not during the "course of their employment" would not be included. This ruling applies even if the employer is not involved in the actions of the employee.

It is extremely important that employees and volunteers have guidelines for behaviour. This also has to be carefully enforced.
