Occupier's Liability

The organization or individual in possession of property has a duty of care to those who come onto the premises.

The occupier must take reasonable care to protect others from harm. This harm could come from a third party on the premises or as a result from programs on the premises. An example would be that the occupier should ensure that the building is safe by removing debris from the entrance and exit areas.

The tenant of the property is not the only one who could be held accountable in a law suit. The owner of the building could also be named. It is important that if you own or occupy a building that you have a risk management program in place and enforce this program.
