A contract does not always have to be written. At times an oral contract can be just as binding as a written one. If certain circumstances occur then a contract must be written. These would include if the object of the contract is land, if the contract is a guarantee of some sort, if the period of the contract extends past a one year period or at times in regards to the debts of an estate.

A contract is an agreement made by two or more persons. This agreement has to be intended to be enforceable at law. One person has to offer something to the other person, to do or not do some thing. Everyone has to accept this offer for it to be valid.
